BSM complies with current legislation on data protection and ensures the correct use and processing of personal data. Each personal data collection form provides information on the purpose of the processing of the data requested. 4. For what purposes do we process personal data?

The personal data of the data subject are processed for the purpose of managing and developing the contracted services.

Likewise, the data subject's personal data may be processed for the following additional purposes, provided that they have been consented to by the data subject:

  • Sending information and communication of commercial promotions regarding the services contracted and requesting participation in opinion surveys, for which we may carry out purchase profiles and analysis of habits based on the information obtained.
  • Inclusion of data in a database shared by BSMSA, PATSA and CBSA.
  • Sending information and communications in relation to the services, activities and promotions of the BSM Group, for which we may carry out purchase profiles and habit analysis based on the information obtained. 
5. How long will we keep the data?

The personal data provided by the data subject will be kept while the contract between the data subject and the BSM Group is in force, and once it is terminated they will be blocked until the applicable statute of limitations expires. 

If you have given your consent to the processing of the data, until the interested party requests their deletion, at which time they will be blocked until the applicable statute of limitations expires.

6. What legitimises us to process the data?

The legal basis for the processing of the data subject's personal data is the performance of the contract. In this regard, the data subject is obliged to provide the data necessary for the performance of the contract. If this data is not provided, the conclusion of the contract will not be possible.

For all other processing, the legal basis is the prior and unambiguous consent of the data subject.

7. To which recipients may we disclose data?

The personal data of the Interested Party may be transferred to the following recipients:

  • BSM Group companies.
  • Public Administrations when so established by an applicable legal provision and Courts and Tribunals.
  • Suppliers who provide services to BSM Group related to the management of the contract formalised and who have the status of data processors. In any case, the third parties with whom certain personal data of the Data Subject is shared must previously accredit the adoption of adequate measures for the correct protection of the data.
8. What are the rights of data subjects in relation to the data they provide us with?

Any person has the right to obtain confirmation as to whether we are processing personal data concerning him/her. Data subjects have the right to access their personal data, as well as to request the rectification of inaccurate data or, where appropriate, to request deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

In certain cases, the Data Subject will have the right to request the limitation of the processing of their data, in which case we will only keep them for the exercise or defence of claims.

In certain circumstances and for reasons related to their particular situation, data subjects may object to the processing of their data. In this case, the BSM Group entities to which this right is exercised will cease to process the data, except for compelling legitimate reasons or for the exercise or defence of possible claims.

In any of the above cases, the relevant BSM Group entity shall communicate any rectification or erasure of personal data, as well as any limitation of processing carried out, to each of the recipients to whom the personal data have been communicated, unless it is or requires a disproportionate effort. If so requested by the Data Subject, the BSM Group entity concerned shall inform him/her of these recipients.

The Data Subject shall also have the right to receive the personal data concerning him/her that he/she has provided to BSM, in a structured, commonly used AND machine-readable format, or to transmit it to another data controller where the processing is based on consent or a contract, and is carried out by automated means.

The Data Subject shall have the right to object at any time, on grounds relating to his or her particular situation, to personal data relating to him or her being processed on the basis of public or legitimate interest by BSM Group or a third party, including profiling, in order for BSM or another BSM Group entity to stop processing the personal data, unless they can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the Data Subject, or for the formulation, exercise or defence of claims.

Likewise, the Data Subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects or significantly affects him/her, unless this decision is necessary for the conclusion or performance of a contract with BSM or another entity of the BSM Group and is authorised by the European or State law in force or is based on the explicit consent of the Data Subject.

9. How do we get the data?

The legal basis for the processing of the data subject's personal data is the performance of the contract. In this regard, the data subject is obliged to provide the data necessary for the performance of the contract. If this data is not provided, the conclusion of the contract will not be possible.

For all other processing, the legal basis is the prior and unambiguous consent of the data subject.

BSM does not process specially protected data for the purposes described above.

10. Video surveillance

BSM will process the images captured by the camera AND video camera systems (in the recording and real-time viewing modes) in accordance with the following information:

PURPOSE: To preserve the security and protection of persons and property as well as to preserve the security and operability of the entity's equipment and facilities.

LEGITIMATE: The legal basis for the processing of images through camera or video camera systems on the entity's premises is:

  • The fulfilment of a public interest mission consisting of guaranteeing the security of people, goods and facilities.
  • The legitimate interest consisting of the need for BSM.SA, responsible for the processing, to establish supervisory measures for the verification of compliance by workers with their work obligations.

RECIPIENTS: The images may be transferred to the State Security Forces and Corps, as well as to the Courts and Tribunals in compliance with a legal obligation applicable to BSM.SA as data controller.

CONSERVATION: The images captured by the video surveillance camera recording system will be kept for a maximum period of one month from their capture. Once this period has elapsed, they will be deleted, except when they must be kept to accredit the commission of acts that threaten the integrity of persons, goods or installations.

In cases where the camera system used is real-time viewing, the images shall not be retained insofar as no recording or storage of images is carried out.
